The right to free speech, i.e. to freely utter ones opinion, is among the central pillars of democracy. But how is this right justified? What is it's exact scope and where are its limits? These are the central themes of the seminar. First, we will encounter several philosophic arguments for the right of free speech. Concerning the second question, we will discuss whether this right applies to non-verbal utterances or, more generally, to actions and whether the right to free speech also extends to non-citizens and to collective actors. Finally, concerning the limits of free speech, we will discuss the cases of lies, slander and discrimination. We will also discuss political speech and political donations, as the latter are sometimes defended on grounds of free speech. Finally, we also address the paradox of free speech, i.e. the question of what to do when protected speech is used to argue against this very right.
